State Open Government Official Addresses New Lebanon Compliance Concerns

NY NEW LEBANON — State open government official addresses New Lebanon document-access disputes. Robert Freeman, Executive Director of the New York State Committee on Open Government, held a public forum April 29 to address resident complaints that the Town Supervisor is withholding meeting materials from board members, the Town Clerk, and the public, contrary to state Open Meetings Law and Freedom of Information Law. Town Clerk Colleen Teal reported materials arrive as little as ten minutes before board meetings, leaving insufficient time for review.
Freeman told the three Town Board members present (Councilmembers Chuck Geraldi, Matthew Larabee, and Dan Evans) that they can enforce compliance by declining to vote without adequate information and by invoking the board's majority authority; the Supervisor, he stressed, is one of five.
